Terms of Service & End-User Licence Agreement

Please read these Terms carefully before using Spotter. By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.
1. The Service
Spotter ("the app", "we", "us") is a fitness-reference tool that provides AI-assisted exercise detection, workout logging, nutrition tracking, and coaching chat. All content — including AI form tips, calorie estimates, training suggestions, and coaching responses — is for general fitness reference only. It does not constitute medical, physiotherapy, dietetic, or other professional advice, and must not be treated as such.
2. Licence Grant
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Spotter on any Apple-branded device you own or control, subject to the App Store Terms of Service. You may not copy, modify, distribute, sell, or sublicense any part of the app.
3. Eligibility
- You must be at least 13 years old (or the minimum age in your jurisdiction) to use this app.
- By using the app you confirm that you meet the age requirement and that the information you provide is accurate.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at support@spotterhk.com if you suspect unauthorised access.
5. Acceptable Use
You agree not to:
- Use the app for any unlawful purpose or in violation of any applicable law
- Attempt to reverse-engineer, decompile, or tamper with the app
- Use the app to harass, harm, or defraud any person
- Upload or transmit any content that is illegal, defamatory, or infringes third-party rights
- Attempt to circumvent quota limits or access controls
6. AI Features & Accuracy
- AI pose detection, rep counting, and form feedback are generated automatically and may contain errors.
- Calorie and nutrition estimates are approximate and may differ from actual values.
- InBody report parsing by AI may not extract all values correctly — always verify against the original report.
- AI coaching chat responses are not a substitute for advice from a qualified trainer, dietitian, or medical professional.
7. Health & Safety Disclaimer
Exercise carries inherent risk. By using Spotter you acknowledge and agree that:
- You are in suitable physical condition to undertake the activities you record or attempt.
- If you have any injury, chronic illness, cardiovascular condition, or are pregnant, you must consult a qualified medical professional before beginning any exercise programme.
- You will stop immediately if you experience pain, dizziness, shortness of breath, or any other discomfort.
- We are not liable for any injury, loss, or damage arising from your use of or reliance on the app.
8. Spotter Pro — Subscription Terms
- The free tier includes a limited number of daily AI uses per feature. A Spotter Pro subscription removes these limits and unlocks all AI features.
- Free trial: New subscribers receive a 7-day free trial. You will not be charged during the trial period.
- Auto-renewal: After the free trial, your subscription auto-renews at the applicable price (monthly or annual) unless you cancel at least 24 hours before the end of the current period. Renewal is charged within 24 hours before the period ends.
- Payment: Payment is charged to the Apple ID account confirmed at purchase. All billing is handled by Apple; we do not store your payment card details.
- Managing or cancelling your subscription: Go to App Store → your Apple ID → Subscriptions → Spotter. You can cancel at any time; access continues until the end of the paid period.
- Refunds: We do not issue refunds for partial subscription periods. Refund requests are handled by Apple in accordance with their standard refund policy.
- Price changes: We may change subscription prices with reasonable notice. Continued subscription after a price change constitutes acceptance of the new price.
- Pro status is linked to your Apple ID and will be restored on reinstall via Restore Purchases.
- We reserve the right to modify, suspend, or discontinue Pro features at any time with reasonable notice.
9. Peer Sharing
- If you generate a share code, your workout history and progress will be visible to anyone who enters that code.
- You can revoke sharing at any time from within the app.
- We are not responsible for how recipients use the data you choose to share.
10. Intellectual Property
All intellectual property in the app — including software, design, text, and graphics — belongs to us or our licensors. Your personal fitness data belongs to you. You grant us a limited licence to process your data solely to provide the service.
11. Privacy
Our collection and use of personal data is described in our Privacy Policy and the Personal Information Collection Statement below, both of which form part of these Terms.
12. Third-Party Services
The app uses third-party services including Supabase, PostHog, Sentry, and an AI provider. Use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of these third parties beyond our data-processing agreements with them.
13. Disclaimer of Warranties
The app is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability.
14. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or in connection with your use of the app.
15. Termination
We may suspend or terminate your access to the app at any time if you breach these Terms. You may delete your account at any time from within the app (我的 → 刪除帳戶). Termination does not affect any rights or obligations that accrued before termination.
16. Changes to Terms
We may update these Terms from time to time. The updated Terms will be posted at this URL with a revised effective date. Continued use of the app after changes are posted constitutes your acceptance of the updated Terms.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising out of these Terms or your use of the app shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong SAR.
18. Apple App Store Additional Terms
This EULA is between you and us only, not Apple Inc. Apple is not responsible for the app or its content. In the event of any conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service shall prevail. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app.

一、收集個人資料的目的
本應用程式收集個人資料的目的包括：
- 建立及管理用戶帳戶，提供登入及身份核實服務
- 根據閣下的身體數據提供個人化健身追蹤、訓練計劃、AI 動作教練及 AI 健康問答服務
- 計算閣下的健康估算數據（包括 BMI、基礎代謝率、每日總消耗熱量、建議蛋白質攝取量）
- 透過 AI 後端生成動作分析、飲食識別及 InBody 體成分解析結果
- 與閣下就帳戶、技術支援或資料查詢事宜聯絡
- 進行使用統計及應用程式改善分析
- 偵測、診斷及修復技術問題及崩潰

📝 相機及訓練片段數據：使用 AI 動作教練時，閣下拍攝或選取的訓練片段會截取少量畫面，經由我們的安全後端傳送至 AI 供應商作動作分析。原始影片檔案不會上傳，只保留在閣下裝置上；截取的畫面僅用於產生該次分析結果，其後不作保留。
三、個人資料的轉移及披露
閣下的個人資料可能被轉移至或被以下各方獲取，惟各方均僅為提供其服務之目的而處理相關資料：

我們將在私隱條例規定的 40 日內回應查閱或更正要求。
五、資料保留
帳戶及健身資料保留至帳戶刪除為止。刪除帳戶後，所有個人資料將立即從我們的資料庫中永久移除。技術及分析數據按各第三方服務供應商的標準政策保留。

All content provided by Spotter — including but not limited to AI form coaching, rep-count detection, calorie estimates, nutrition breakdowns, body-composition calculations (BMI, TDEE, BMR, body-fat %), training plan suggestions, and AI health-coach chat responses — is provided for general fitness reference purposes only.
This content:
- Is not a substitute for professional medical, physiotherapy, dietetic, or nutritional advice
- Has not been reviewed or approved by any medical authority
- May not be accurate or appropriate for your individual health situation
Exercise Risk
Physical exercise carries inherent risk of injury. Before beginning any exercise programme using Spotter, you should:
- Consult a qualified physician or healthcare provider, especially if you have or suspect any injury, chronic illness, cardiovascular condition, metabolic condition, musculoskeletal condition, or if you are pregnant or postpartum
- Ensure you are exercising in a safe environment with appropriate equipment
- Warm up adequately and use proper technique
- Stop immediately and seek medical attention if you experience chest pain, severe shortness of breath, dizziness, fainting, severe joint or muscle pain, or any other unusual symptoms
AI Detection Limitations
The AI pose-detection system estimates body-joint positions from camera images using machine-learning models. Its outputs:
- May be inaccurate depending on camera angle, lighting, clothing, body size, or movement speed
- Should not be used to diagnose movement disorders, assess rehabilitation progress, or make clinical decisions
- Are intended only as a general motivational and informational reference during training
The app displays a safety reminder during AI coach sessions: "AI 提示僅供參考，如感到任何痛楚，請即停止。" (AI tips are for reference only — stop immediately if you feel any pain.)
Nutrition & Body Composition
- Calorie and macronutrient estimates from AI food photo or text analysis are approximations only and may differ significantly from actual values
- BMI, TDEE, BMR, and recommended protein calculations are estimates based on population-level formulas and may not reflect your individual physiology
- InBody scan values extracted by AI from report photos may not be perfectly accurate; always refer to the original printed report
- Nutrition information should not be used to manage any medical condition, eating disorder, or chronic disease without professional guidance
No Doctor-Patient Relationship
Use of Spotter does not create a doctor-patient, therapist-client, or any other professional relationship between you and us. We are not healthcare providers.
Limitation of Liability
To the fullest extent permitted by applicable law, Spotter and its operators shall not be liable for any injury, illness, death, loss, or damage of any kind arising from or related to your use of the app, your reliance on any content generated by the app, or any exercise activity undertaken in connection with the app.
